The rules of using Peptiter.

Peptiter is a clinical decision-support platform — not a prescriber, not a pharmacy, not an autoprescribing AI. These Terms govern access for clinics, pharmacies, telehealth groups, and individual licensed prescribers.

1. Acceptance

By accessing the Peptiter platform you agree to these Terms of Service and our Privacy Policy. If you are using Peptiter on behalf of a clinic, pharmacy, or telehealth group, you represent that you are authorised to bind that entity.

2. What Peptiter is — and is not

Peptiter is a clinical decision-support tool for licensed prescribers. It is FDA CDS Exempt under the 21st Century Cures Act §520(o)(1)(E): the prescriber must independently review every recommendation. Peptiter does not practise medicine, does not autoprescribe, does not dispense, and is not a substitute for clinical judgement.

3. Eligibility

Prescriber accounts require a valid licence in good standing in the jurisdiction of intended use. You are responsible for the accuracy of credentials provided and for complying with all applicable laws, including controlled-substance regulations.

4. Acceptable use

Do not (a) use Peptiter to make autonomous prescribing decisions without prescriber review, (b) reverse-engineer the scoring engines, (c) re-identify de-identified data, (d) use the platform for any unlawful purpose, or (e) circumvent rate limits, audit logs, or security controls.

5. Customer data & BAA

You retain all rights to data you upload. We process Protected Health Information as a Business Associate under HIPAA pursuant to a signed BAA. See the Privacy Policy for collection, use, and retention details.

6. Fees & AKS-clean economics

Peptiter charges a flat monthly platform licence. We take zero per-prescription fees and zero pharmacy referral fees. Fees are invoiced monthly or annually as agreed in your order form. Late payments may result in suspension after 30 days written notice.

7. Intellectual property

Peptiter, its scoring engines (OII, CIR), the DiscoverRx pipeline, and the platform UI are owned by Peptiter Inc. You receive a limited, non-exclusive, non-transferable licence to use the platform for the term of your subscription.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Recommendations are decision support only. Clinical outcomes depend on factors outside our control.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEPTITER'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE FEES PAID BY YOU TO PEPTITER IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

10. Indemnification

You agree to indemnify Peptiter against third-party claims arising from your prescribing decisions, your use of the platform in violation of these Terms, or your violation of applicable law.

11. Termination

Either party may terminate for material breach with 30 days written notice and an opportunity to cure. On termination, you may export your data for 60 days; thereafter we may delete it subject to legal-hold and retention obligations.

12. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware, except where applicable law provides otherwise.

13. Changes

We may update these Terms from time to time. Material changes will be notified to account administrators by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
